Terms and Conditions for Landscaping Sidcup
These Terms and Conditions set out the basis on which landscaping services in Sidcup are provided by the service provider to the customer. By making a booking, accepting a quotation, or allowing work to commence, the customer agrees to be bound by these terms. They are intended to create a clear understanding of the process for arranging work, how payments are handled, what happens if plans change, and how responsibilities are shared during and after completion. These terms apply to domestic and commercial customers unless a separate written agreement says otherwise.
Landscaping Sidcup services may include garden design, turfing, planting, paving, fencing, hedge work, soil preparation, clearance, and related outdoor works. Because every site is different, some details may be confirmed in the quotation, job sheet, or written order before the work begins. If there is any inconsistency between these Terms and Conditions and a written quotation specifically issued for the project, the written quotation will usually take precedence for that project, provided it does not conflict with law. The customer should read all documents carefully before accepting them.
For the purpose of these terms, “we”, “us”, and “our” refer to the landscaping service provider, and “you” or “the customer” refers to the individual, business, landlord, tenant, or organisation that books the service. A booking may be accepted only where the customer has authority to permit the work, including any permission needed from a landlord, managing agent, freeholder, or other relevant party. The customer is responsible for ensuring that the service area is available and that the job can proceed safely and lawfully.
1. Booking Process
A booking for Sidcup landscaping services is normally made after an enquiry, site visit, or review of photographs and measurements. Where possible, a quotation will be provided describing the scope of work, estimated timing, assumptions, and any exclusions. The quotation may be revised if new information becomes available, including hidden conditions, access difficulties, unstable ground, drainage issues, or changes requested by the customer before work starts. A booking is only confirmed once the customer agrees to the quotation or other written confirmation and, where required, pays any deposit requested.
We may need to arrange a survey before confirming the final price for landscaping in Sidcup. The customer should provide accurate information about the property, including access points, services, boundaries, known hazards, and any restrictions affecting the work. If the customer gives incomplete or incorrect information and this affects planning, cost, materials, or timing, we may adjust the quotation or schedule accordingly. We are not responsible for delays or additional costs caused by inaccurate details supplied by the customer.
Appointments and project dates are offered subject to availability. Any times or dates given are estimates unless expressly confirmed as fixed in writing. Weather, supply issues, sickness, transport disruption, or contractor availability may require changes to the start date or working hours. We will use reasonable efforts to notify the customer of changes and to reschedule where appropriate. Landscaping Sidcup projects may also be carried out in phases, and the order of tasks may be adjusted if needed for safety, materials, or practical reasons.
Acceptance of Work
By confirming a booking, the customer accepts these terms and confirms that the requested work may proceed. If a customer wants a variation after acceptance, such as a change in materials, layout, finish, or plant selection, the change must be agreed before implementation and may affect the price and completion date. No work outside the agreed scope is guaranteed unless it has been accepted in writing.
We may refuse or cancel a booking if the site is unsuitable, unsafe, inaccessible, or likely to create a breach of law or regulation. In such cases, any deposit handling will follow the cancellation provisions below. The customer should ensure that pets, children, vehicles, ornaments, fragile items, and other valuables are kept clear of the working area unless they are specifically included within the project. Where the customer asks us to move items, this will only be done if it is safe and reasonable to do so.
2. Payments and Pricing
Prices for landscaping services in Sidcup will usually be set out in the quotation and may be fixed for the agreed scope, unless stated otherwise. Unless the quotation says that prices are inclusive, all amounts are exclusive of VAT where VAT is applicable. Any estimate is given in good faith based on the information available at the time, but it is not a final price unless expressly confirmed as such. If the scope changes or hidden issues are discovered, the price may need to be revised.
Payments may include a deposit, staged payments, progress invoices, and a final balance on completion. Deposits are used to secure materials, labour, and scheduling, and may be non-refundable except where required by law or where we are unable to deliver the service. Unless otherwise agreed in writing, invoices are due within the time stated on the invoice, quotation, or job sheet. Late payment may result in paused work, rescheduling, recovery action, and, where permitted by law, interest and reasonable debt recovery costs.
The customer must ensure that payment is made from an authorised account and that cleared funds are available when due. If a cheque, transfer, card payment, or other method fails, we may suspend work until payment is received in full. Any materials purchased specifically for a job, such as paving, timber, gravel, topsoil, turf, or planting stock, may become non-returnable once ordered or delivered. We may require payment in advance for special-order items or custom elements.
3. Cancellations, Delays, and Changes
As a consumer customer, you may have rights under the Consumer Contracts Regulations 2013 where they apply, although landscaping services often involve bespoke work and scheduled dates which may affect cancellation rights. If you wish to cancel, you should notify us in writing as soon as possible. If cancellation occurs after materials have been ordered, labour has been allocated, or preparatory work has begun, you may be charged for our reasonable costs already incurred. This may include administration, sourcing, delivery, and non-recoverable expenses.
If the customer cancels a booking with short notice, we may retain part or all of any deposit to cover lost time and administrative costs, to the extent permitted by law and by the quotation. For larger landscaping Sidcup projects, a staged cancellation charge may apply depending on how far the works have progressed. If we cancel due to operational reasons, we will normally offer an alternative date or refund any sums paid for undelivered work, subject to any lawful deductions for work already completed at the customer’s request.
We may suspend, delay, or withdraw from the project if there is a material breach of these terms, if unsafe conditions arise, if payment is overdue, or if the customer prevents reasonable access. We may also delay work where weather conditions make the work unsafe or unsuitable, such as during excessive rain, frost, high winds, or extreme heat. Where practicable, we will suggest an alternative time for completion. However, we are not liable for delay caused by events outside our reasonable control.
Customer Changes
If you request a change after work has started, we may need to revise the price, labour allocation, sequence of tasks, or completion date. Any agreed variation should be confirmed in writing where possible. This helps avoid misunderstandings and ensures that both sides have a clear record of what has been approved.
4. Liability and Responsibility
We will carry out landscaping in Sidcup with reasonable skill and care, using suitable materials and methods for the agreed purpose. Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be limited. Subject to that, we are not responsible for indirect or consequential losses, loss of profit, loss of enjoyment, or losses caused by factors beyond our control.
Where work involves ground levels, drainage, retaining features, or existing structures, outcomes may be affected by hidden conditions not visible during inspection. We are not responsible for defects arising from pre-existing problems, poor subsoil conditions, historic movement, buried services, or work carried out by others before or after our service. The customer should disclose any known issues affecting the site. If specialist investigation, structural advice, utility marking, or planning permission is needed, it is the customer’s responsibility to obtain this unless we agree otherwise in writing.
We are not liable for damage to underground services, cables, pipes, drains, or other fixtures where the customer has not provided accurate information or where services are unmarked, concealed, or incorrectly mapped. Likewise, we are not responsible for damage to items left in the work area, unless such damage is caused by our negligence and was reasonably foreseeable. The customer should remove or protect fragile items, garden furniture, ornaments, and similar possessions before work begins.
Landscaping Sidcup projects may involve machinery, sharp tools, heavy materials, powered equipment, and manual handling. The customer agrees to keep unauthorised persons away from the work area while work is in progress. Any instruction given by the customer that is unsafe, unlawful, or contrary to good practice may be refused. If the customer asks us to continue despite obvious risk, we may stop work and treat the issue as a variation or suspension.
Guarantees and Materials
Any guarantee or warranty will apply only if stated in writing. Natural materials, plants, timber, and stone can vary in appearance, size, tone, and durability, and such variation is not a defect. Planting outcomes may depend on weather, watering, soil condition, and aftercare. We may provide advice about maintenance, but ongoing care remains the customer’s responsibility unless a maintenance agreement says otherwise.
5. Waste, Removal, and Environmental Compliance
Waste generated by landscaping services in Sidcup may include soil, turf, branches, leaves, old fencing, paving offcuts, packaging, and general green waste. Unless the quotation states otherwise, waste removal may be charged separately. All waste will be handled in accordance with applicable UK waste regulations, including the duty of care, carrier obligations, and lawful disposal or recycling arrangements. We may use licensed waste transfer or recycling facilities and may keep records where required by law.
The customer must not ask us to dispose of hazardous or controlled waste unless we have expressly agreed and are legally able to do so. Hazardous materials may include asbestos, contaminated soil, chemicals, oils, treated waste requiring special handling, or any item classified by law as hazardous. If such items are discovered, work may be paused and additional arrangements may be necessary. Extra charges may apply where specialist disposal, testing, segregation, or protective measures are required.
Green waste, timber, hardcore, and other materials may be separated for recycling or recovery where reasonably practical. The customer agrees that materials removed from the site become waste once they are placed for disposal unless otherwise agreed in writing. If the customer wishes to retain any removed materials, they must tell us before work starts or before removal occurs. We are not responsible for items left for collection if the customer later changes their mind after disposal arrangements have been made.
Waste must be presented and stored safely on site until it is removed, and the customer should not interfere with waste containers, skips, loads, or stored materials without permission. If waste is contaminated by items added by the customer or another person after collection preparation, we may refuse removal or charge additional costs to comply with legal disposal requirements. The customer is responsible for ensuring that no prohibited waste is mixed with normal garden waste unless we have agreed a suitable process in advance.
6. Access, Site Conditions, and Health and Safety
The customer must provide safe and reasonable access to the property, including space for workers, tools, materials, and vehicles where required. If access is restricted by parking limits, narrow entries, locked gates, shared areas, or ongoing building work, the customer must inform us in advance. Delays caused by limited access may affect timing and price. We may refuse to carry heavy or bulky materials through areas that are unsafe or likely to be damaged unless a suitable arrangement has been agreed.
The customer is responsible for making us aware of known hazards such as fragile surfaces, unstable ground, hidden chambers, unprotected edges, livestock, aggressive animals, or electrical installations near the work area. We may take reasonable safety measures, but we cannot guarantee to identify every hidden issue. If a site becomes unsafe during the work, we may stop immediately until the risk has been resolved. Any delay or additional cost caused by unsafe conditions may be charged to the customer where permitted by law.
We may request that utilities are isolated or that certain areas are kept clear before work begins. The customer should also protect interior areas if the project requires repeated access through the home or business premises. We are not responsible for accidental tracking of soil, dust, or debris into the property where reasonable protection was not provided or where the customer requested continued use of the area during active works. Care will still be taken to minimise disruption.
7. Complaints, Defects, and Completion
If the customer believes there is an issue with the completed Sidcup landscaping work, they should notify us within a reasonable time and provide details of the concern. We may inspect the matter and, where appropriate, offer a remedy, adjustment, or further work. Minor differences in finish, colour, texture, growth, or natural settling do not necessarily amount to a defect. Works involving fresh planting, turf, newly laid surfaces, and ground preparation may require a period of settling or establishment.
Completion occurs when the agreed work has been substantially finished and is ready for use, even if minor items remain that do not affect safe operation. If the customer occupies or uses the site before completion, or instructs us to leave certain items unfinished, the work may be treated as practically complete for billing purposes. Any snagging list should be communicated promptly so that we can review and, if necessary, address the issue within a reasonable period.
8. Governing Law and General Terms
These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from or connected with the agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer rights provide otherwise. If any part of these terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force.
8. Governing Law and General Terms If we choose not to enforce any part of these terms at any time, that does not mean we have waived our right to enforce it later. Any amendment must be agreed in writing by both parties. These terms form the entire agreement between the customer and the landscaping service provider in relation to the relevant work, unless supplemented by a separate written contract. By proceeding with a booking, the customer confirms that they have read, understood, and accepted these conditions for landscaping services in Sidcup.
These Terms and Conditions are designed to provide fairness, clarity, and consistency across projects of different sizes. They protect both the customer and the service provider by setting expectations around booking, payment, cancellation, liability, waste handling, and legal compliance. If a project requires further terms due to its scale, specialist materials, or external contractor involvement, those additional terms may be added in writing before work commences.
